These Terms and Conditions ("Terms") form an agreement between you and HairAnalyst ("we", "us") governing your use of the HairAnalyst website, application, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Not medical advice

HairAnalyst is an informational tool. It analyzes scalp photos and check-in data to surface trends and educational content. It is not a medical device, not a diagnosis, and not a substitute for a qualified healthcare professional. Always consult a licensed clinician before starting, stopping, or changing any treatment. If you have a medical emergency, call your local emergency number.

2. Eligibility and account

You must be at least 16 years old to use the Service. You are responsible for keeping your login credentials secure and for activity on your account. Notify us promptly if you suspect unauthorized use.

3. Subscriptions and billing

  • Free baseline. Your baseline scan is free and does not require a payment method.
  • HairAnalyst Pro. Pro is offered as an annual plan at $120 per year or a monthly plan at $12.99 per month. Prices are in US dollars and exclude any applicable taxes.
  • Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled.
  • Cancellation. You can cancel in one click from your account at any time. Cancellation stops future renewals; the current period continues until it ends.
  • Refunds. Except where required by law, payments are non-refundable. Annual plans cancelled mid-term remain active until the period ends.
  • Price changes. We may change prices for future billing periods with reasonable notice.

4. Your content

You retain ownership of the photos and information you upload ("Your Content"). You grant us a limited license to host, process, and analyze Your Content solely to provide and improve the Service for you. We do not sell Your Content and we do not use your photos to train third-party advertising or generative models.

5. Acceptable use

You agree not to:

  • Upload photos of anyone other than yourself without their explicit consent.
  • Reverse engineer, scrape, or attempt to extract source data from the Service.
  • Use the Service to violate any law or the rights of others.
  • Interfere with the security or integrity of the Service.

6. Intellectual property

The Service, including its software, models, design, and content (excluding Your Content), is owned by HairAnalyst or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific health, hair, or cosmetic outcome.

8. Limitation of liability

To the maximum extent permitted by law, HairAnalyst will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising from the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

9. Termination

You may delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to us or to other users. On termination, the license granted to you ends and we will delete Your Content in accordance with our Privacy Policy.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. The parties consent to exclusive jurisdiction in the state and federal courts located there, except where local consumer protection law gives you the right to sue locally.
